Jurnal Verstek is a peer-reviewed journal published by Procedural Law Department, Faculty of Law, Universitas Sebelas Maret three times a year in April, August, and December. This Journal aims primarily to facilitate undergraduate students paper over current developments on procedural law issues in Indonesia as well as to publish innovative legal researches concerning Indonesian procedural laws and legal system. It provides immediate open access to its content on the principle that making research freely available to public support a greater global exchange of knowledge. The scope of the articles published in this journal deal with a broad range of topics in the fields of Procedural Law, included but not limited to legal construction of procedural law, critical construction of procedural law in practice, trends and changes in procedural law, and the technical challenges faced in proedural law.

Abstract

ABSTRAKTujuan penelitian hukum ini adalah untuk mengetahui tentang bagaimana pertimbangan hakim dalam menjatuhkan putusan pada tindak pidana perjudian sabun ayam yang terdapat unsur adat budaya di dalamnya, serta untuk mengetahui bagaimanakah yang dimaksut dengan upaya preventif dan edukatif dalam pemidanaan perjudian sabung ayam di Bali ini. Metode yang digunakan dalam penelitian hukum ini bersifat preskriptif dan terapan. Pendekatan yang digunakan adalah pendekatan kasus yang dilakukan untuk memecahkan isu hukum yang dihadapi dengan tujuan untuk mengetahui ratio decidendi. Pengumpulan bahan hukum dilakukan dengan studi pustaka. Penelitian ini bersumber pada bahan hukum primer yang berupa perundang-undangan dan putusan pengadilan dan bahan hukum sekunder yang berupa buku, jurnal, dan artikel. Teknik analisis bahan hukum menggunakan metode deduktif silogisme, yaitu menggunakan premis mayor dan premis minor kemudian diambil konklusi. Hasil yang diperoleh peneliti dari penelitian hukum ini adalah bahwa hakim memasukkan unsur budaya sebagai hal yang meringankan pada pertimbangan hakim, dan upaya preventif dan upaya edukatif adalah upaya yang dilakukan oleh pemerintah dalam upaya penanggulangan dan upaya mengubah pola perilaku masyarakat.Kata kunci : Pertimbangan Hakim, Tajen, Perjudian ABSTRACTThe purpose of this legal research is to find out about how the judges consider in making decisions on criminal acts of cockfighting gambling that have elements of cultural customs in them, and to find out what is meant by preventive and educative efforts in this cockfighting gambling in Bali. The method used in legal research is prescriptive and applied. The approach used is a case study conducted to solve legal issues faced based on existing laws and regulations. Collection of legal materials is done by literature. This research is based on primary legal material in the form of legislation and court decisions and secondary legal material in the form of books, journals and articles. The legal material analysis technique uses the deductive syllogism method, which uses a major premise and a minor premise then taken conclusions The results obtained by researchers from this legal research are that judges incorporate cultural elements as things that alleviate judges' consideration, and preventive efforts and educative efforts are efforts made by the government in efforts to overcome and attempt to change people's behavior patterns.Keyword: consideration of the judge, Tajen, Gambling
